OCWAP Enforcement Action Summary:
McDougal Bros., Inc.

Based on our review of the Clean Water Act permit file for this facility at the Oregon Department of Environmental Quality’s Eugene office, it appears that McDougal Bros., Inc. has never sent discharge monitoring reports to DEQ since first obtaining permit coverage in September of 1998. (The permit requires permit holders to send discharge monitoring reports to DEQ once a year.) Our review of the file for this facility also indicated that the stormwater pollution control plan on file for it fails to meet the minimum requirements for such a plan in a number of respects (e.g., the plan is unsigned, contains no description of spill prevention and response procedures, and contains no description of an employee education program, all of which are required by the permit). We sent McDougal Bros., Inc. a letter on behalf of Willamette Riverkeeper on March 22, 2007 informing McDougal Bros., Inc. that we would file a Clean Water Act suit against McDougal Bros., Inc. on behalf of Willamette Riverkeeper unless McDougal Bros., Inc. addresses the permit violations outlined above. Oregon Clean Water Action Project is engaged in an ongoing dialog with McDougal Bros., Inc. that is aimed at resolving these violations.
