Discharges: Teevin Bros. Land & Timber Co., LLC has Clean Water Act permit coverage for industrial stormwater discharges from this site, which are regulated under Oregon’s statewide general industrial stormwater permit, which was issued by and is administered by the Oregon Department of Environmental Quality (DEQ).

Oregon’s statewide general industrial stormwater permit allows permit holders to discharge industrial stormwater provided that they prepare and implement a stormwater pollution control plan, perform required monitoring of discharges, and report the results of this monitoring to the DEQ. Oregon’s statewide general industrial stormwater permit includes “benchmarks” for total copper, total lead, total zinc, pH, total suspended solids, and total oil & grease, and if monitoring of stormwater discharges reveals exceedance of any of these benchmarks, the permit holder must review and, if necessary, revise its stormwater pollution control plan accordingly. Compliance History: OCWAP initiated an enforcement action against Teevin Bros. Land & Timber Co., LLC on behalf of Willamette Riverkeeper in December of 2008 concerning Teevin Bros. Land & Timber Co., LLC’s discharge of stormwater from its Eugene facility without a Clean Water Act permit. Teevin Bros. Land & Timber Co., LLC subsequently applied for and received coverage under a Clean Water Act permit, paid $5,000 to Oregon Toxics Alliance for use in water quality-related projects in the Long Tom Watershed, and agreed to pay additional funds to Oregon Toxics Alliance in the event of specified future violations of its Clean Water Act permit.

Teevin Bros. Land & Timber Co., LLC received Clean Water Act permit coverage on April 10, 2009, and pollution levels in samples taken during the 2008-2009 monitoring period (which runs from July 1 to June 30) were within permit benchmarks. Pollution levels for samples taken during the 2009-2010 monitoring period failed to meet permit benchmarks on four different dates, including total suspended solids of 255 milligrams per liter (mg/l) on February 26, 2010 (versus a permit benchmark of 130 mg/l), and low (acidic) pH levels in December and April. The City of Eugene sent Teevin Bros. Land & Timber Co., LLC a request for corrective action on August 16, 2010 concerning Teevin Bros. Land & Timber Co., LLC’s failure to submit action plans addressing its failure to meet pollution benchmarks.
